These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms set out the rights and obligations of all users regarding the use of the Service and tour bookings.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. By accessing the Website or booking a tour, You agree to be bound by these Terms. If You disagree with any part, You may not access the Service or book tours.

You represent that You are over the age of 18. The Company does not permit those under 18 to make direct bookings without parental or guardian consent.

Your access to and use of the Service is also subject to Our Privacy Policy, which describes how We collect, use, and disclose personal information.

Tour Bookings, Payments, and Cancellations

Booking & Payment Policy

  • Confirmation: All tour bookings made via the Website or direct communication are subject to availability and confirmation by Discover Sal Tours.
  • Prices: All tour prices are stated in Euros (€) or Cape Verdean Escudos (CVE) unless specified otherwise. We reserve the right to modify prices, but price changes will not affect confirmed bookings.
  • Payment Terms: Full payment or a required deposit must be made at the time of booking or according to the payment schedule specified during checkout/confirmation.

Cancellations & Refunds

If You wish to cancel a booked tour, the following cancellation policy applies:

Less than 24 hours before tour start Non-refundable
No-show at pickup time/location Non-refundable

Weather & Safety Cancellations by the Company

Excursions and water-based activities are dependent on weather and ocean conditions in Sal, Cape Verde.

  • If a tour is canceled by Discover Sal Tours due to bad weather, safety concerns, or unforeseen operational reasons, You will be offered:

    1. An alternative date/time for the tour, or
    2. A 100% full refund.
  • Discover Sal Tours is not responsible for secondary expenses incurred due to cancellations (e.g., flight changes, hotel adjustments).

User Conduct & Passenger Safety

  • Pickup Details: You are responsible for providing accurate hotel/accommodation details and being present at the designated pickup location at the specified time.
  • Health & Safety: You must ensure that You and any members of Your party are physically fit for the tour activities booked (e.g., swimming, hiking, off-road driving). Please inform us of any medical conditions prior to the tour.
  • Behavior: We reserve the right to refuse service or terminate a tour for any participant displaying disruptive, abusive, dangerous, or intoxicated behavior without obligation to issue a refund.

Intellectual Property & Website Content

The Service and its original content, features, photos, and functionality are and will remain the exclusive property of Discover Sal Tours and its licensors. Content on discoversaltours.com may not be copied, reproduced, or republished without prior written permission.

Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Company shall not be held liable, directly or indirectly, for any damage or loss caused by or in connection with the use of such external content, goods, or services.

Termination

We may terminate or suspend Your access to the Website immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Discover Sal Tours, its directors, employees, or partners be liable for any indirect, incidental, special, or consequential damages resulting from:

  • The use or inability to use the Website or Services.
  • Physical injuries or loss of personal items during excursions that occur outside the reasonable control of the Company or due to failure to follow safety guidelines.
  • Unexpected delays caused by traffic, weather, or third-party service vendors.
Our total liability to You for any claim arising out of or relating to these Terms or tour services shall not exceed the total amount actually paid by You to Discover Sal Tours for the specific booking in question.

“AS IS” and “AS AVAILABLE” Disclaimer

The Website and its digital content are provided to You “AS IS” and “AS AVAILABLE” without warranty of any kind. Discover Sal Tours expressly disclaims all warranties, whether express, implied, or statutory, regarding the operation of the website, information accuracy, or virus-free server availability.

Governing Law & Dispute Resolution

Governing Law

The laws of Cape Verde, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service.

Informal Dispute Resolution

If You have any concern, feedback, or dispute regarding Our Services, You agree to first try to resolve the dispute informally by contacting Discover Sal Tours directly.

For European Union (EU) Consumers

If You are a European Union consumer, You will benefit from any mandatory provisions of the consumer protection laws of the country in which You are resident.

Severability and Waiver
